The initial Alpha Fitness Tracker service is intended for people age 18 and older. By using the service, you agree to these terms and represent that you meet the applicable eligibility requirements.
2. General wellness only
Alpha Fitness Tracker is a general-wellness product. It is not a medical device and does not diagnose, treat, cure, or prevent disease. Nutrition, calorie, body-composition, and workout information consists of estimates and educational guidance and is not medical advice.
Consult a qualified professional before acting on information when you have a medical condition, take medication affecting diet or exercise, are pregnant or breastfeeding, have eating-disorder concerns, or are otherwise unsure whether an activity is appropriate. Stop an activity and seek help if you experience concerning symptoms.
3. Accounts and accurate information
You are responsible for safeguarding account access and providing information that is accurate enough for the features you use. You remain responsible for reviewing recommendations, food entries, portions, substitutions, and workout choices before relying on them.
4. Estimates and automated features
Recommendations may be provisional, incomplete, or wrong. Food-photo analysis, barcode matches, body-fat inputs, calorie ranges, and workout plans require your judgment and confirmation. Alpha does not promise a particular rate of progress, body composition, performance result, or date.
5. Acceptable use
You agree not to:
- Use the service unlawfully or to harm, harass, or exploit another person.
- Attempt to bypass security, access another user’s records, or disrupt the service.
- Upload content you lack the right to use or that contains malicious code.
- Reverse engineer or misuse the service except where applicable law permits it.
- Present Alpha’s estimates as professional medical diagnosis or treatment.
6. Third-party services and information
The service may rely on Apple services, nutrition databases, hosting providers, authentication providers, and other third parties. Third-party services and data may be unavailable, delayed, incomplete, or governed by their own terms. Alpha is not responsible for services it does not control.
7. Ownership and feedback
Alpha Fitness Tracker and its original software, design, and content are protected by applicable intellectual-property laws. You retain rights in content you submit. You grant the limited permissions needed to process that content to provide the service. If you voluntarily provide feedback, we may use it without obligation to you.
8. Beta features and changes
Pre-release and beta features may change, contain errors, or be withdrawn. We may update, suspend, or discontinue features and will provide notice when required by applicable law.
9. Disclaimers
To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, availability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the extent permitted by law, Alpha Fitness Tracker will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill resulting from use of the service. Any limitations apply only to the maximum extent permitted by applicable law.
11. Termination
You may stop using the service and request account deletion. We may suspend or terminate access for material violations, security risk, or legal requirements, subject to applicable notice and appeal rights.
12. Applicable law and changes
These terms are governed by applicable law. We may update them as the service develops; material changes will be communicated when required. Continued use after an effective update constitutes acceptance where permitted by law.
